Would you make them pay?


As you may have read in the County Fair Week thread, Neba was "attacked" last night at the Dog Cookie Contest.  It was a case of 1 too many dogs for the amount of plates of cookies.  After the fact, the girl who owns the dog that bit Neba said to me "Well, my dog has been ugly(attitude) lately".  As far as I am concerned, that should have been the reason to not have taken her dog into the ring for the contest and upon finding out that she would have to share a plate she should have 1.) declined to be in the contest, 2.) explained to one of the judges why she would not take part, and 3.) left the ring.  Would you say that she was at fault and should pay the vet bill or should I just let it go, pay the bill and not say anything?

     Michaela,  Poor baby,  I know Neba is a brave girl.  I hope she doesnt have any problems with the bite.  Of course they should pay.  That is a given.  Check with your local law enforcement codes.  Not having your dog under control is a no-no.  Also, I think its poor planning for that  event.  When you put that many (?) dogs together with food, asking them to share is a recipe for disaster.  Food aggression is pretty strong in some dogs.  Especially dogs that are strangers to each other and  from different packs.  My dogs are fed with their bowls 3 feet from each other, no matter how laid back they are or seem to be.  Common dog sense tells you that.  As for the responsibility for the bill - please dont back down, present the bill to her parents.  Its their obligation to cover it.  Its begging for a law suit if they don't.  Besides, it would be the right thing to do.  If one of my dogs bit someone or another animal, animal control could pick up my dog and if aggressive enough they could euthanize it.   Please kiss Neba on her pretty nose and tell her Auntie Leslie loves her and will beat up anybody who hurts her again.

I will Lesley!  She was happy to see us this morning when we picked her up after her overnight stay at the vet.  There were even a couple of people from the group that asked about her today at the fairgrounds!  She's on chewable antibiotics 2X's a day for 10 days and I have to keep her face clean with peroxide ("we" don't like that!).   She is resting right now, but Morgan and I are planning on going over to the fairgrounds tonight for a gift certificate drop at 6:00 and then the free concert at 7:00 and I think we will take Neba so that we can show her that everytime she goes over there, she won't be attacked.

Kisses and hugs to Neba.  We knew she was brave.  I hope she doesn't have any after-effects from her injury.  Emotionally as it were.  Keep me posted.  Congrats on the awards.  Hope you are having fun with the rest of the fair.

Oh no Oreosmom. I am so sorry to learn of this very upsetting news.
I voted for them to pay for it all. Granted I was not at it the event to see it. Maybee Id go half. But I would most definately make them pay.

Well, I finally caught the parents of the kid with the other dog tonight.  Aside from being really nasty to me, they informed me that they had no intentions of paying for any treatment for Neba.  Apparently the husband called or talked to my vet either Monday night or yesterday (before even seeing the copies of the bills) and suposedly the vet told him that no treatment had been necessary at all.  BS!!!!  Oh! and get this!  The wife called me an over-reacting B**** and that she had been watching me all year and that I over react to EVERYTHING in my life and around me.  Needless to say, there will be a case being filed hopefully soon in small claims court.  I need to get their names, adresseses, and phone numbers to fill in on the paperwork.  The 4H group won't give it to me and the Fair Board won't give it to me either.  Apparently, since I have talked to too many people about it, now everyone is hush hush about who they are.  I am so mad right now!  I have written everything down so that when they deny having said any of those things, at least I have it in writing.  I wish I had had one of those micro tape recorders on me tonight!

I can not belive that they wont pay for it. Not even a potrtion. How awfull. You can allways send them a copy of your bill and call the vet and let them know  what happened. maybe the vet can let them know about the bill. You have because of this majoy issue. I hope all works out in the end for you.

I know that they saw a copy of the bill last night.  I suspect it was the first time they saw it by the way that they were looking at it.  Then when I was able to chase them down to calmly talk about it, I was called names, accused of having my dog where it didn't belong, how Neba viciously bit Morgan three times last night and I did nothing about it, and how they had talked to my vet already and the vet had told them that Neba hadn't needed any treatment of any kind and that I pushed him into putting in un-necessary stitches, therefore, they weren't going to pay anything.  Neba NEVER bit Morgan last night, and if she had that is my business because it happened within my family, she didn't snap at anyone else.  She has NEVER bitten anyone let alone break Morgan's skin.  She gives warning snarls to Morgan when she is doing something that Neba doesn't like such as startle Neba while she's sleeping.  The whole thing started when Neba was about 2-3 feet away from the plates of cookies, and their dog barged in, then turned and jumped on Neba.  The girl holding their dog could only hold onto the leash and get pulled behind the dog.  She had no control what-so-ever in this situation.

sounds like it could get ugly. The vet had no right to talk to them about Nebas treatment.  Talk to the vet and see what he has to say about it.  They may not be telling the whole truth.

We are already in the process of finding a lawyer and Bill wants me to go talk to the police today since neither 4H or the Fair Board or Fair Office will give me their names.  I agree with you that the vet had no right to talk to them about Neba.  Doesn't this follow along the doctor/patient priviledge?  I am Neba's guardian, so therefore, I should have been informed about any conversations reguarding this with the right to NOT allow information be released.

I got a call this morning from one of the members of the Fair Board.  She told me that the President of the Fair Board wants to talk to me, that 4H has nothing to do with the Cookie Contest, it is a Fair sponsored event so therefore, the leader of the 4H dog group needs to be left out of this and that I should let it go, just pay the bill, go on my way, but that I am more than welcome to come over and enjoy the fair!  Excuse me? Let it go?  NOT!

oreosmom... people today I dont get it . If that was them in your shoes. i am sure the other person would have to pay. I would get a lawyer for sure and see what he or she has to say.

If they were in my shoes, I would have already been served with papers on Tuesday!!  I don't get where people are coming from these days either.  Part of owning an animal is taking responsibility for any resulting bills IF your animal should bite someone or another animal.  I'm waiting to see what the officer says before I think about going over there.  Bill says I should take Morgan and Neba in the office to "talk" to this guy and inform him that I will not be backing down on this.  What if Morgan had gotten in between the dogs in her attempt to help Neba?  Would they have said, "just take her home and put a band aid on it"?

Well, this guy has gone into hiding.  The other day when I was supposed to go talk to him, he was busy all afternoon and into the evening with the rabbit and poultry shows, today he is busy with the kiddie pedal pull, the talent contest and closing down the fair as well as packing up his camper and going home.  Can I get his name again?  Are you kidding!!  There's a cover up afoot here.  It's a conspirasy I say!
